Import for re-export: bringing devices into Malaysia only to send them out again.

Repair centres, sterilisation and relabelling sites, testing labs and regional distribution hubs handle devices that are never sold in Malaysia. MDA does not require them to be registered, but it does require an IRE approval letter before the first shipment lands.

Short answer: a medical device imported into Malaysia only to be exported again (for repair, testing, sterilisation, packaging, labelling or a distribution hub) does not need MDA registration, but the importer must obtain an IRE approval letter from MDA first. Apply at least 21 days before import; MDA takes about 14 working days. The letter lasts 12 months and every device must leave before it expires (MDA/GD/0069).

Who the IRE route is for

  • Service and repair centres receiving devices from other countries for maintenance, then returning them.
  • Contract sterilisation, packaging and labelling sites that process devices for a manufacturer and ship them on.
  • Testing laboratories running verification or investigation work on devices that are not registered in Malaysia.
  • Regional distribution hubs holding stock in Malaysia for other ASEAN markets. MDA/GD/0069 lets principal and distribution hubs leave the quantity out of the application, in exchange for quarterly import and export declarations.

It is not for devices made in Malaysia purely for export (that is the export-only route and Export Certificate), nor for research-use-only devices (MDA/GD/0016). A device that will be sold or used in Malaysia needs MDA registration.

What goes into the application

  1. Applicant details: company, address, whether it is a licensed establishment (and its licence number and role), contract manufacturer or other, the person responsible and a contact person.
  2. Purpose and facility: the purpose ticked on the form and the address and person in charge of the facility where the work happens.
  3. Supporting documents for the purpose: for repair, testing, sterilisation or investigation, the IFU or package insert and the service provider’s quotation; for packaging or labelling, the IFU or package insert and evidence of the relationship with the other party, such as an authorisation letter, delivery order or ISO 13485 certificate.
  4. Attachment 1, the device list: name, brand and model, intended use, manufacturer, HS code and quantity (not compulsory for multiple-shipment hubs).
  5. Import details: date of importation, tentative export date, entry point (land, sea, air) and whether it is a single or multiple shipment.
  6. Attestation: the person responsible declares the product is a medical device, that it will not be placed on the Malaysian market, and that it will stay on board or at the stated storage address while in Malaysia. A false declaration is an offence under section 76(1) of Act 737 (fine up to RM100,000, up to 2 years’ imprisonment, or both).

The person responsible must be from top management: a proprietor, director, CEO, managing director or general manager, or a manager they authorise.

The conditions on every IRE approval

  • Every device must be re-exported before the approval expires.
  • The approval covers only the devices and the site address approved.
  • MDA may visit or inspect the premises at any time without notice, and may revoke the approval if a condition is broken.
  • All documents about the devices are kept at the premises and shown to MDA on request.
  • IRE records are kept as part of the distribution records required by the Medical Device (Duties and Obligations of Establishments) Regulations 2019.
  • Devices that cannot be re-exported are declared to MDA; excess devices are disposed of under MS 2650.
  • The IRE approval may not be advertised (section 44 of Act 737).
  • Using the approval to place devices on the Malaysian market is an offence under section 5: a fine up to RM200,000, up to 3 years’ imprisonment, or both.
  • Once the approval expires or is cancelled, no further import or export is allowed under it.

Jawapan ringkas · Bahasa Malaysia

FAQ

Frequently asked questions

What is an IRE approval letter?
It is MDA’s written approval to import a medical device that is not registered in Malaysia, for the sole purpose of exporting it again, for example after repair, testing, sterilisation, packaging or labelling, or through a distribution hub. The Medical Device (Exemption) Order 2024 exempts such devices from registration under section 5 of Act 737, and MDA/GD/0069 (First Edition, March 2025) sets the application process.
Who can apply for import for re-export?
A company registered in Malaysia, a licensed establishment or a forwarding agent that is responsible for importing the device. The application form lets an applicant without an establishment licence apply. The applicant must first be sure the product is a medical device; if unsure, it can apply to MDA for product classification.
How early must we apply?
MDA/GD/0069 says to apply not less than 21 days before the date of importation. MDA’s processing time is about 14 working days from a complete application. If MDA asks for more information and it is not supplied within 30 working days, the application is treated as withdrawn.
How long is the approval valid?
12 months, for the device, quantity and site address approved. It allows multiple shipments within that period, and every device must be exported before it expires. The letter cannot be amended; a change to the device or quantity needs a new application. If export cannot be finished in time, a subsequent application filed at least 14 working days before expiry can extend it by up to 6 months.
What do we file after the devices leave Malaysia?
A Declaration on Import for Re-export Records (Annex C of MDA/GD/0069) within 30 days after the export, with the Customs Form No. 2 (K2) export declaration, by email to MDA’s exemption unit. It states the quantity exported and any balance left in Malaysia. Distribution hubs with multiple shipments file import and export declarations quarterly.
Can we sell some of the devices in Malaysia?
No. An IRE device must not be placed on the Malaysian market. Using an IRE approval to place devices on the market is an offence under section 5 of Act 737, punishable by a fine of up to RM200,000, imprisonment of up to 3 years, or both. To sell in Malaysia, the device needs MDA registration.
Is import for re-export the same as export only?
No. Export only covers devices made in Malaysia purely for export, through an Export Only Exemption Letter under MDA/GD/0051. Import for re-export covers devices brought into Malaysia and sent out again. Devices for research use only follow MDA/GD/0016 instead.
What happens to devices that cannot be re-exported?
They must be declared to MDA, and any excess devices not exported must be disposed of safely following MS 2650, Guidance on Disposal of Medical Devices. After the IRE approval expires or is cancelled, no further import or export of the device is allowed under it.
